Universitetet i Oslo - International Constitutional Law and Democracy

The increasing Europeanization and internationalization of law have resulted in increasingly international processes of legislation. This is also occurring on areas which previously have been considered to be primarily of internal interest for the nation states and their legislative institutions. Several and very comprehensive treaties have been made into national legislation or have given supranational organizations the competence to legislate with direct internal effect. Parts of the EC/EU treaties are supranational in character. Several treaties have also established courts or other conflict-resolution mechanisms which have contributed significantly to the increased efficiency of the implementation of international law. The meaning of the concepts of sovereignty and democracy relating to the constitutions of the nation-states are thus distinctly influenced. The same would be true for the status of the democratic legitimacy of law.

Universitetet i Oslo - Women's Law and Human Rights

This course presents the international legal framework for women's human rights with emphasis on basic principles such as equality, non-discrimination, freedom, integrity and dignity embedded in the UN Convention on the Elimination of All Forms of Discrimination against Women (CEDAW). The non-discrimination principle is elaborated in the light of the CEDAW, the Convention on Civil and Political Rights, EU-directives and the Protocol to the African Charter on the Rights of African Women. The non-discrimination principle is substantiated through a focus on the right to work, the right to health , the right to education and the right to land. Taking a cross-cut through civil and political and social and economic human rights the course deals with the protection against violence in criminal law, housing law and asylum law. The indivisibility of human rights is demonstrated through the right to health, food, land and water. The relationship between different human rights principles, such as gender equality, freedom of religion and protection of custom and culture is given particular attention. Rather than concentrating on the laws of one country the course offers case studies from Europe, Africa and Asia. The case studies demonstrates how international human rights law is translated into national and local law. Studies of local water management practices in Zimbabwe, shariah councils in Britain and attempts of abolishing FGM among Norwegian immigrants provides empirical insight into the relationship between human rights and legal pluralism. The case studies constitute the departure point for a broader theoretical understanding of gender, human rights, multiculturalism and legal pluralism.

Universitetet i Oslo - Family and Asceticism in the Theology of Jesus and Paul

The New Testament constitute the basis for Christian preaching and teaching. Family and marriage are very important issues in Christian teaching, and are often regarded as central to Christian views on ethics, anthropology and society. Therefore it is often taken for granted that they play this role in Jesus’ teaching and in the New Testament in general. And household and marriage were central institutions in the Hellenistic world of the time, justified thorugh cosmology and religious beliefs. But many New Testament texts have a different message in that hey are critical of family and marriage and instead advocate asceticism. A focus on texts about family and asceticism therefore provides unique insight into the dilemmas and conflicts the Jesus movement and Early Christian groups faced in establishing themselves in their Hellenistic and Jewish contexts. These texts give insight into the roots of Christianity in Judaism and the formation of Christianity in its non-Christian, Hellenistic environment, through cultural integration and dialogue but also through counter-cultural stands and confrontation.
