Within the classical Arabic literary tradition, the textual variants known as Alf layla wa-layla have a truly ambiguous status, at once influential and marginal to the understanding and practice of adab. This course will engage with critical readings of Alf layla wa-layla, set into conversation with texts such as al-Tanoukhiâs al-Faraj baâd al-shidda and al-Ramhurmuziâs âAjaâib al-Hind. Readings will be in Arabic.

The first part of the course covers the historical development of Islamic law, its sources, and tools of law-finding. The second part, which concentrates on the modern period, gives an overview of different areas of law, such as commercial law, criminal law, family law and the position of women, law and the state, and human rights.

The basic question is how can Islamic Law (Shari`a) remain relevant and applicable in present Islamic societies, whether Muslims constitute the majority or minority of the population. Following an introduction to the nature, sources and techniques of Shari`a, and its main concepts, principles and rules, the course will focus on the relationship between Shari`a and modern legal systems, and examine some of the social and cultural implications of adherence to Shari`a among Muslims today. Possible substantive aspects of Shari`a to be considered include transactions and contracts, banking and commercial law, and family law and inheritance, international law and human rights. The course will highlight and illustrate the issues in a range of countries where Muslims constitute the predominant majority of the population, and for Muslim minorities in Western countries, and concludes with an overview and discussion of the future of Shari`a.
